Kampala. Court has found former Buganda Kingdom Minister of State for Economic Planning and Development Rajni Taylor guilty of defaulting a Usd.20.000 loan from Prime Finance Limited.
Mr. Taylor took the loan on August 16, 2016 and entered an agreement with Prime Finance Company Limited where he was granted USD 20.000 payable in three weeks (August 27th, 2016).
But he failed to pay within the agreed period of time and the lender had in civil suit No. 703/2019 sued Taylor into the commercial court for defaulting the loan. Taylor however challenged the suit in a miscellaneous application 778/2019 in which in affidavits, he averred that he had paid up all the loan within the agreed period and he owed no one any money.
During presentation of evidence, presiding judge, Justice Abinyo found that although Taylor claimed to have paid up the loan, he contacted the lender a month away from when he claimed to have paid the loan asking them to settle out of court.
The said quoted letter is dated August 29, 2019, and in it, Taylor asked Rajir Ruperellia to settle the matter out of court and proposed Tuesday 3rd September 2019 as the date to meet.
Therefore, Justice Suzan Abinyo of the Commercial court ruled in a May10, 2021 judgment that she found the defense of Mr. Taylor contradictory and therefore granted Prime Finance reparations.
“Following the above discourse between the parties, I find the applicant’s assertion that he paid the loan facility in three weeks unacceptable in the circumstances and the question arises is why then did the applicant make partial payments (on later dates).” Justice Abonyo ruled.
“As a result, I find that the applicant has failed to raise triable issues and plausible defense to warrant the grant of leave to appear and defend the suit”Abinyo said.
Court therefore slapped Taylor with USD 40.048 (Shs.142,771,120-One hundred forty two million, seven hundred seventy one thousand, one hundred twenty shillings) and costs of the suit.
In 2019, several Indian community members hauled him to police for failure to pay back hundreds of dollars which they had been lending to him. He issued them with cheques worth millions of shillings but most of them bounced, hence being arrested.
