KAMPALA-UGANDA/NEWSDAY; Controversial city lawyer Felix Kintu Nteza has been dragged into yet another case of fraud involving a multibillion land for which he and others allegedly faked papers to deprive it from a South Sudanese investor in 2018.
Mr. Nteza, another lawyer KS Nsubuga of Nsubuga KS of Nsubuga & Co Advocates and other defendants including Hakim Kasirye, Mugisha Robert, Jjuuko Budalla, among others filed a fictitious case in the High court Land Division and fraudulently, illegally and without the plaintiff’s instructions and presence entered into a sham consent where they purported terminated the plaintiff’s lease on the suit land.
It is upon that consent judgement that the commissioner Land Registration based to cancel a rightful lease that had earlier been offered to investor Dingkiuu Deng Goc Ayuel.
After knowing about the fraud that the Sudanese filed a case against the defendants and High court judge Olive Kazaarwe has now cancelled the judgment saving Dingkiuu’s land located in Bweyogerere Buto on Block 226 plot 691.
In her judgement, Kazaarwe noted that the evidence which was brought before her, there was no doubt the Sudanese had no knowledge about the consent judgement.
“This evidence demonstrates that the applicant did not appear in person and yet the pleadings suggest that he affixed his signature on the affidavit in support and the consent order. For the first time on bench I was introduced to a new term ‘idle lease’ coined by the first respondent and his advocate. The term does not exist in law. A lease either exists or it does not,” Kazaarwe ruled.
Court records show that with the help of Nteza and Nsubuga, Mugisha filed cause No.071/2018 seeking orders for cancellation of Dingkuii’s lease on Block 226/2018.
Mr. mugisha described the lease as idle and that it was encumbered on the white on the white page WAK0013715 of 31.10.2017. Mugisha applied to have reentry and the land registrar advised the gets a court order, which was granted leading to cancellation of a 99-year lease.
Mr Nteza is not new to land fraud allegations. He is currently battling a near sh195m relating to a botched land deal.
In this case, Mr. Nteza is under indictment for obtaining money by false pretense for a property whose existence he allegedly know was hot air, but because of desire for cash, according to prosecution papers, he went ahead and signed.
He is being charged contrary to section 305 of the Penal Code Act at Buganda Road Chief Magistrate Court in Kampala City. If convicted, he faces a punishment of five years in jail.
Court documents state that, Nteza, in a bid to obtain the money, concocted a situation that the runners of the estate of the late Gorge Kamya and the beneficiaries of the estate were selling land at Busiro block 220, plot 64 land at Gimbo in Wakiso district whereas not. Prosecution is led by Shifrah Nyadoi
