KAMPALA-UGANDA/NEWSDAY: Buganda Kingdom’s top royalty and officials are stampeding after the family of King Muteesa Walugembe lost an appeal case against businessman Muhammed Buwule Kasasa.
The appeal was filed by the administrators of the Estate, Prince David Wassajja, Nalinya Sarah Kagere and Dorothy Nassolo against businessman Muhammed Buwule Kasasa and the attorney general seeking recovery of the land but court upheld Dr Kasasa’s bonafide ownership of the land on MRV 962 Folio 19.
They also sought court declaration that all transactions on the land were illegal and that Dr Kasasa did not lawfully acquire the land. This land was first registered as owned by Sir Edward Muteesa Ii on June 13,1968 but later transferred into Paul Andrew Benjamin Kwemalamala by Victoria.
The court of appeal however on Monday held a March 20, 2020 High court ruling in which the family of King Mutesa II family was told they held invalid. The royals opted to appeal. But on Monday November 14, ruling, a Coram of three justices including Justice Elizabeth Musoke, Justice Christopher Gashirabake and Lady Justice Eva Luswata in a unanimous judgement dismissed the appeal with costs.
After the ruling, businessman Kasasa has said “they have received what they went for- paying costs, getting ashamed, being humiliated. You can’t file something bogus because you want to earn free- to deprive others of what belongs to them.”
He warned the appellants will be heavily “and the worst has not yet come. They have been collecting money from my land for twenty years.”
“You can’t make a false claim from a huge land involving multi billions,” Kasasa said.
But sources from Mengo said on Thursday the royals were preparing an appeal.
“The man who won the case is in his evening hours. There will certainly be an appeal, not because the appellants think they will but to delay justice. You never know what may happen to the old man before the determination of the new appeal. You should know why the high court case lagged on for 20 years,” a source told Newsday.
